1. Scope of Application
1.1 These General Terms and Conditions (hereinafter "GTC") of Hasan Akten, trading as "Ahsen Ebru" (hereinafter "Seller"), apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller regarding the goods displayed in the Seller's online store. The inclusion of the Customer's own terms is hereby rejected unless otherwise agreed.
1.2 These GTC also apply to contracts for the delivery of vouchers, unless otherwise expressly regulated.
1.3 A consumer, according to these GTC, is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur, in terms of these GTC, is a natural or legal person or a partnership with legal capacity who acts in the course of their trade, business, or profession when concluding a legal transaction.
2. Conclusion of Contract
2.1 The product descriptions contained in the Seller's online store do not constitute binding offers but serve as an invitation for the Customer to submit a binding offer.
2.2 The Customer can submit the offer via the online order form integrated into the Seller's online store. By clicking the button completing the order process, the Customer submits a legally binding offer regarding the goods in the shopping cart. The offer can also be made via telephone, fax, email, postal mail, or the online contact form.
2.3 The Seller may accept the Customer’s offer within five days:
- By sending a written order confirmation or confirmation in text form (fax or email), with the receipt by the Customer being decisive,
- By delivering the ordered goods, with the receipt of the goods by the Customer being decisive, or
- By requesting payment from the Customer.
3. Right of Withdrawal
3.1 Consumers generally have a right of withdrawal.
3.2 Detailed information on the right of withdrawal is provided in the Seller’s withdrawal policy.
3.3 The right of withdrawal does not apply to consumers who, at the time of concluding the contract, are not a member of the European Union and whose sole residence and delivery address are outside the European Union.
4. Prices and Payment Conditions
4.1 The prices listed include statutory VAT. Additional delivery and shipping costs are indicated in the respective product descriptions.
5. Delivery and Shipping Conditions
5.1 Goods are shipped to the delivery address specified by the Customer. The Seller’s specified shipping address is decisive.
6. Retention of Ownership
The Seller retains ownership of the delivered goods until full payment is received.
7. Liability for Defects (Warranty)
7.1 In case of defects, legal warranty regulations apply.
8. Redeeming Promotional Vouchers
8.1 Promotional vouchers issued free of charge cannot be purchased and are valid for a specified period in the Seller’s online store.
